A New Jersey traffic offense for reckless driving can result in serious consequences. New Jersey statute (N.J.S.A. 39: 4-96) defines reckless driving as driving “a vehicle heedlessly, in willful or wanton disregard of the rights or safety of others, in a manner so as to endanger, or be likely to endanger, a person or property.” A reckless driving offense occurs when a driver willfully endangers others or the property of others. Penalties for reckless driving include imprisonment, a fine, a surcharge, and points recorded on the driver’s record.
Punishment for Reckless Driving
A first offense for reckless driving can result in imprisonment in the county or municipal jail for up to 60 days, or a fine of at least $50 but not more than $200, or both. A second or subsequent reckless driving conviction can result in imprisonment of up to three months, or a fine of at least $100 but not more than $500, or both. A reckless driving traffic offense that occurs in a highway construction zone will result in a doubled fine. A driver convicted of reckless driving may also have to pay an annual surcharge to the state if the driver has accumulated six or more points within three years.

New Jersey, like other states, assigns a point value for each traffic violation. More severe traffic violations will result in more points while minor violations incur fewer points. A traffic conviction in New Jersey for reckless driving will result in five points added to the driver’s record. Points can result in an increase in a driver’s insurance premium.
